DMCA Takedown Policy

1. Overview

Happy Hear Audio ("Happy Hear Audio," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act ("DMCA").

We will promptly respond to valid DMCA takedown notices and remove or disable access to allegedly infringing material in accordance with federal law.

3. How to File a DMCA Takedown Notice

If you believe that content on our platform infringes your copyright, please send a written DMCA takedown notice to our designated agent with the following information:

Required Information:

  1. Your contact information: Full name, mailing address, telephone number, and email address
  2. Identification of copyrighted work: Description of the copyrighted work that you claim has been infringed, or if multiple works, a representative list
  3. Identification of infringing material: Specific location on our platform where the allegedly infringing material appears (URL or other specific identification)
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement: A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf
  6. Physical or electronic signature: Your physical or electronic signature

4. Our Response Procedure

Upon receiving a valid DMCA takedown notice, we will:

  1. Review the notice for completeness and validity within 1 business day
  2. Remove or disable access to the allegedly infringing material promptly
  3. Notify the user who posted the material about the removal and provide a copy of the takedown notice
  4. Inform the user of their right to file a counter-notification
  5. Document the process for our records and legal compliance

5. Types of Content Covered

This DMCA policy covers the following types of content on our platform:

  • Audio recordings: Customer-uploaded audio files, event recordings
  • Transcripts: AI-generated transcriptions of audio content
  • User accounts: Profile information, branding assets, custom content
  • Website content: Blog posts, help documentation, marketing materials
  • Generated content: AI-processed audio analysis, emotion tags, summaries

6. Counter-Notification Process

If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:

Required Information for Counter-Notice:

  1. Your contact information: Full name, address, telephone number, and email address
  2. Identification of removed material: Description of the material that was removed and its location before removal
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for your address (or Los Angeles County if outside the US) and that you will accept service of process from the complainant
  5. Physical or electronic signature: Your physical or electronic signature

7. Repeat Infringer Policy

Happy Hear Audio has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also permanently delete audio content that has been the subject of multiple valid DMCA takedown notices.

8. Processing Times

  • Takedown Notice Review: Within 1 business day
  • Content Removal: Within 24 hours of valid notice
  • User Notification: Within 2 business days of removal
  • Counter-Notice Review: Within 3 business days
  • Restoration (if applicable): 10-14 business days after counter-notice, unless we receive notice of legal action

9. False Claims

Please note that filing a false DMCA takedown notice may result in liability for damages, including costs and attorneys' fees. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.
